Appeals before the Supreme Court, the Constitutional Court and the European Court of Human Rights

Our practice in extraordinary appeals covers the following areas:

The filing of cassation appeals in civil and criminal jurisdictions before the Supreme Court, constitutional appeals (amparo) before the Constitutional Court, and applications before the European Court of Human Rights (ECHR) requires a highly specialised legal technique. These are all extraordinary remedies, subject to strict procedural requirements that are rigorously reviewed by these courts, whose admission rates are notably low.

 

At Guerrero Abogados, we are specialists in handling this type of proceedings and have taken part in numerous landmark cases. Our experience includes, among others, interventions in Constitutional Court judgments Nos. 178/2011, 179/2011 and 125/2017; Supreme Court (Civil Chamber) judgments Nos. 558/2018 of 9 October and 171/2020 of 11 March; as well as Criminal Chamber judgments Nos. 99/2015 of 24 February and 265/2020 of 29 May.


In relation to proceedings before the European Court of Human Rights, our Partner Salvador Guerrero Palomares, PhD in Procedural Law and Professor of Procedural Law at the University of Malaga, has completed extensive specialised training in Strasbourg on ECHR procedures and is currently a Tutor of the Human Rights Education for Legal Professionals (HELP) Programme of the Council of Europe, the organisation under which the European Court of Human Rights operates.
